Open Atelier booking terms
1. Scope
These terms apply to bookings of the Open Atelier at Casa del Arte, Costa d'en Brossa 4, 07001 Palma. Your contractual partner is ARTBOX.GROUPS GmbH, Schmidgasse 4, 6300 Zug, Switzerland, with its permanent establishment ARTBOX GROUPS SPAIN, Costa d'en Brossa 2, 07001 Palma (CIF N0247983J).
2. What you get
- Use of the furnished studio with easel during the weeks booked, Monday to Friday from 11 am to 6 pm. Access is only possible during these gallery opening hours.
- Painting tools and acrylic paints on site, free of charge in the usual amount
- An open studio: gallery visitors may watch you at work
Accommodation, travel, meals, insurance and materials beyond what is available are not included. You organise these yourself.
3. Booking and contract
You book whole weeks from Monday to Friday, up to 4 weeks in a row and at least 14 days in advance. Weeks with a public holiday cannot be booked.
The contract is concluded once your payment has succeeded and you have received our confirmation by e-mail. For a booking request without online payment, the contract is only concluded with our written confirmation.
4. Price and payment
The weekly price shown at the time of booking applies. Spanish VAT (IVA) at the applicable rate, currently 21 %, is added on top. Before paying you see the total amount including IVA. The full amount is due at booking and is paid in euros via SumUp.
5. Cancellation by you
Please let us know by e-mail as early as possible if you cannot come. The date we receive your e-mail is decisive.
- Up to 30 days before the start: full refund minus a handling fee of 50 euros.
- 29 to 14 days before the start: 50 % refund.
- Less than 14 days before the start or no show: no refund.
Up to 30 days before the start you can move your booking once to other free weeks at no cost. You may also send another artist in your place if you tell us beforehand.
As the studio is reserved for a fixed period, there is no statutory 14 day right of withdrawal (Art. 103(l) of the Spanish consumer protection law TRLGDCU and Art. 16(l) of the EU Consumer Rights Directive).
6. Cancellation by Casa del Arte
If we have to cancel a stay, for example due to force majeure, official orders or damage to the building, we will offer you another free week or refund the amount paid in full. There are no further claims, for example for travel or accommodation, unless we caused the cancellation intentionally or through gross negligence.
7. In the studio
- Treat the studio, furnishings and materials with care and leave the room as you found it.
- Please do not touch the artworks exhibited in the gallery.
- Solvents, spray paints and strong smelling or harmful materials only after agreement with us.
- Our team may end the stay in case of serious violations. In this case there is no refund.
8. Your works, sales, photos and videos
All rights to your works remain with you. We only photograph or film you and your work with your consent and then use the footage on our website and social media, crediting your name. You take your works and materials with you at the end of your stay.
If you sell works during your stay, Casa del Arte takes no commission. You then handle the sale yourself directly with the buyer, including payment, invoice and any taxes. If you would like a sale to go through Casa del Arte, the commission is 30 % of the sale price.
9. Liability
Your personal belongings, works and materials are not insured by us during your stay. You are liable under statutory law for damage you cause to the studio, the furnishings or exhibited works. We are liable for intent and gross negligence and without limitation for injury to life, body and health.
10. Winners of ARTBOXY contests
For stays awarded through a contest on ARTBOXY, these terms apply accordingly, at no cost to you. Please let us know at least 14 days in advance if you cannot take up your week so that we can pass it on.
11. Privacy, law and jurisdiction
How we process your data is described in our privacy policy. Swiss law applies. If you book as a consumer, you keep the mandatory protection of the law of your country of residence and may also bring proceedings where you live. The place of jurisdiction for businesses is Zug, Switzerland.
